Regulations for the reservation and rental of Elite Apartments Tricity Paulina Kozłowska

1. General Provisions

1. These Regulations define the conditions for making reservations for renting apartments. By making a reservation, you accept the provisions of the Regulations. At the time of booking, the rental agreement is considered concluded.

2. Reservation

  1. To book the Service, the Customer fills in and sends it to the ea@eliteapartments.com.pl e-mail address Reservation Form for the selected Premises.
  2. In order to confirm the booking application, Elite Apartments sends the Preliminary Booking Confirmation to the Customer’s e-mail address with information on the amount due, payment date and bank account number.
  3. The reservation is effective upon crediting the bank account of Elite Apartments (or another account indicated by Elite Apartments) with the Reservation Fee.
  4. Elite Apartments sends the Final Booking Confirmation to the e-mail address provided by the Customer, no later than within 24 hours from the date of receipt of the advance payment on the Elite Apartments bank account.
  5. The Final Confirmation of the Reservation together with the Reservation Form constitutes the Apartment Lease Agreement, which enters into force subject to payment of the Price for the Services on the dates and on the terms set out in these Terms.

3. Payment terms

  1. The customer makes a 30% advance payment of the entire amount to the account indicated in the Initial Booking Confirmation, in such a way that the Elite Apartments account is credited no later than in within 3 (three) days from the date of receipt of the Initial Confirmation of the Booking, in any case no later than 2 days before the first day of using the Apartment.
  2. Crediting the Elite Apartments account with an advance payment after the above-mentioned deadline will result in failure to do so The reservation is valid, unless Elite Apartments makes the Final Confirmation Booking.
  3. Payment of the remaining part of the Price for the Service in total, including the down payment – the entire payment for the stay must take place before handing over the rented premises to the Client’s disposal and shall be made in cash or by card upon handing over the keys to the premises.
  4. The price for the service is gross and includes 8% VAT.
  5. The customer has the right to receive a VAT invoice for the total amount of the reservation, provided that all is provided necessary data on arrival.
  6. A one-time service fee may be added to the cost of renting the Apartment, regardless of the number of people and the length of stay, the fact and amount of which must be specified in the Initial Confirmation of Reservation.
  7. Post-season prices apply to stays for a minimum of 7 days.

4. Cancellation of reservation, extension of stay

  1. The customer has the right to cancel the reservation, which he will immediately notify by e-mail.
  2. In the event of cancellation of the reservation, the Customer is not entitled to a refund of the advance payment, i.e. 30% order value. In the event of cancellation of the reservation on the day of arrival, Elite Apartments has the right to collection of the entire amount of the order value from the customer.
  3. If the period of stay in the apartment is shortened by the Customer, the Price for the unused period stay is not refundable.
  4. The customer may increase the number of days of booking by submitting another booking to Elite Apartments, under provided that the dates by which the Customer wants to extend the stay in relation to the Apartment are available.

5. Responsibility

  1. In the event that the performance of the Service as part of the booking intermediation turns out to be entirely impossible due to the fault of Elite Apartments or the landlord, respectively, Elite Apartments undertakes to make every effort to offer a service of a similar standard and within the time specified in the Form Reservation.
  2. If the Customer does not consent to the provision of a service of a similar standard, Elite Apartments is obliged to return the advance payment made by the Reserving Party.
  3. The liability of Elite Apartments for intermediation services in making the Booking and concluding the Service Provision Agreement is in each case limited to the amount of the advance payment. All claims related to non-performance or improper performance of the service should be addressed through Elite Apartments.
  4. Elite Apartments shall not be liable for any difficulties in accessing the reservation system for reasons beyond the control of Elite Apartments. Elite Apartments may suspend access to the website www.eliteapartments.com.pl for the period necessary to remove technical and organizational obstacles.
  5. The use of the common parts is the sole responsibility of the Lessor.
  6. Elite Apartments shall not be liable for any property left in the Apartment, in particular for its loss or damage.
  7. Elite Apartments shall not be liable for any personal injury caused during the stay in the Apartment.

6. Terms of renting the Premises

Klient korzystając z Usługi zobowiązany jest do przestrzegania następujących zasad:
  1. The apartment is rented for days.
  2. Elite Apartments provides conditions for the full and unhindered stay of customers in the Premises.
  3. The number of people who can live in the Premises is limited to the number specified in the offer on the website www.eliteapartments.com.pl and in the reservation made by the Customer. The number of people specified by the Customer in the booking may be changed, provided that it does not exceed the number specified in the offer on the website www.eliteapartments.com.pl. In cases clearly indicated in the offer of the www.eliteapartments.com.pl website, Elite Apartments allows these people to live in an extra bed, for the payment of an additional price. If during check-out it turns out that the number of people staying in the Premises without the consent of Elite Apartments was greater than the one agreed upon during the booking, Elite Apartments has the right to charge the Customer with a fee for an additional person or, if such an option does not exist, a fee of 30% of the total booking price.
  4. The collection of the keys takes place at the place and time indicated in the Confirmation of Reservation. The keys to the premises may not be made available to third parties. Elite Apartments is entitled to identify the person who has not concluded the lease agreement and uses the keys to the Apartment.
  5. The Customer’s accommodation is provided on the condition: – payment of the remaining part of the Price for the Service, – checking the document confirming the customer’s identity (ID card, permanent residence card, passport), – a deposit referred to in point 11
  6. Children up to 18 years of age may stay in the Premises only under the supervision of an adult.
  7. The Client may use the Premises only for residential purposes and may not sublet it further.
  8. The Client is obliged to observe the principles of good neighborliness and to keep the rented premises in good condition. There is a curfew in the restaurant from 22:00 to 6:00. If, as a result of violating the curfew applicable in the Premises, a representative of Elite Apartments or the owner of the premises is called to the Premises by neighbors, the Municipal Police or the Police, B Elite Apartments is entitled to immediately terminate the contract, without the need to return the previously paid rental fee.
  9. The hotel day lasts from 3:00 p.m. on the day of arrival to 11:00 a.m. on the day of departure, at the place and date indicated in the Confirmation of Reservation. Before checking out of the Premises, the technical condition of the Premises and its equipment are checked in the presence of the Customer. Check-in and check-out follow in the apartment in the presence of the Owner or an authorized person. 1
  10. During the stay in the Premises, the Client is obliged to comply with the Rules of Order of the Premises.
  11. The Client bears full financial responsibility for any damage caused by him to the Apartment or its equipment and to the common parts of the Housing Community and neighboring apartments. At the same time, he is obliged to inform the representative of Elite Apartments about any defects, damage or damage caused to the Premises or its equipment, common parts of the Housing Community and neighboring apartments, immediately after their occurrence, regardless of the reason for their occurrence. In the event of damage, the Customer undertakes to cover it no later than on the last day of using the Premises. As a security for the performance of the obligation referred to in this point, when issuing the keys to the Customer, Elite Apartments reserves the right to charge a deposit in the amount of up to PLN 500.00. The deposit is returned on departure, provided that the Apartment is collected by Elite Apartments without any reservations as to its technical condition or its equipment. For any damage caused to the Apartment or its equipment and common parts of the Housing Community and neighboring apartments caused by the Customer, Elite Apartments has the right to retain part or all of the deposit, not less than the equivalent of the estimated cost of removing the damage.
  12. New damages or not reported during the rental will be repaired at the expense of the customer, provided that the customer is notified of the damage noticed by the cleaning team, within 24 hours of departure.
  13. The customer is obliged to pay special attention to the proper operation of water and gas valves and electrical devices. Due to fire protection, the Customer may not use any electrically powered devices that do not constitute the Apartment’s equipment, except for: mobile phone chargers, power adapters, radio receivers, computers, razors, hair dryers. 
  14. There is a total ban on smoking in the Premises.
  15. Elite Apartments is not responsible for the loss or damage of items brought by customers to the Premises. The same applies to customers’ motor vehicles and items left in them.
  16. Elite Apartments shall not be liable for any inconvenience that may occur during the Customer’s stay at the Premises due to the lack of electricity, gas, water supply, restoration works in the building in which the Premises are located, restoration works of devices included in the Premises, as well as due to malfunctions of these devices.
  17. Any additional information is provided on behalf of Elite Apartments by the person confirming the booking with the Final Booking Confirmation.
  18. The total rental price of the Apartment for one day provided on the Website includes: a) the cost of water, gas, electricity consumed by the Customer, the cost of garbage collection from the Apartment, b) ensuring a clean change of bed linen (1 set for the entire Term of Stay), c) subscription for access to the Internet and satellite television (if available in a given Apartment), d) cleaning and preparing the Apartment.
  19. Taking pets with you is allowed only after obtaining permission from the owner of the apartment. The apartment staff has the right to refuse to provide accommodation to guests who took their pet to the facility without prior arrangement. Dogs must be kept on a leash at all times on the property.
  20. Personal data: By making a reservation on the website www.eliteapartments.com.pl, the Customer hereby consents to placing his personal data in the Elite Apartments database. The data will be processed only for the purpose of booking, facilitating subsequent bookings and for marketing purposes in accordance with the provisions of the Act of August 29, 1997. about personal data protection. The person making the reservation has the right to access and update their personal data. Elite Apartments reserves the right to freely change the Regulations at any time. Unregulated the provisions of the Civil Code and relevant laws apply in these regulations.
  21. Elite Apartments is not obliged to provide cleaning agents (including: dishwasher tablets, soap, washing liquids, washing powder, capsules for the coffee machine, etc.).
  22. Prices on the website www.eliteapartments.com.pl apply to stays until 31/12/2018.
  23. To the price of each apartment we add PLN 100 service fee and city tax, which in Gdańsk is PLN 2.20 per person per night, while in Sopot it is PLN 4.40 per person per night.

7. Complaints

1. All complaints regarding the stay should be sent to ea@eliteapartments.com.pl.

DEFINITIONS OF TERMS USED IN THE REGULATIONS:

Price for the Service – remuneration for the Service, also known as the rental fee, Reservation Form – a document constituting the only form of reservation or cancellation of a rental reservation, existing in an electronic version, available at www.eliteapartments.com.pl Premises – premises described in detail on the websites www.eliteapartments.com.pl, which it is subject of the reservation. Final Confirmation of Reservation – Reservation Fee acceptance form, Reservation – the right to use the Premises on the terms specified in the Final Confirmation Booking and these conditions.
